Terms of Service
These Terms of Service govern use of Proactive Energy Solutions websites, forms, communications, and the Partner Portal.
Effective Date: August 28, 2026
These Terms of Service (“Terms”) apply to websites, online forms, communications, and the Partner Portal operated by Express One Industries, doing business as Proactive Energy Solutions (“Proactive Energy Solutions,” “we,” “us,” or “our”).
By accessing or using our website, Partner Portal, forms, or related services, you agree to these Terms. If you do not agree, do not use the applicable website, portal, or service.
1. Purpose of Our Services
Proactive Energy Solutions provides information, lead intake, referral coordination, customer communication, solar and battery education, project support, sales support, and related energy-services activities.
Information provided through our website or Partner Portal is intended to support customer inquiries, referral activities, project coordination, education, training, and general business operations.
2. Partner Portal Access
Access to the Partner Portal is limited to authorized users. Portal credentials are intended for the individual or organization to whom they are issued and should not be shared with unauthorized persons.
We may suspend or terminate access if we reasonably believe an account is being misused, compromised, used in violation of these Terms, or used in a manner that could harm customers, Proactive Energy Solutions, or third parties.
3. Referral Partner Responsibilities
Referral partners are responsible for ensuring that information they submit is accurate to the best of their knowledge and that they have appropriate permission to share a homeowner’s personal information with Proactive Energy Solutions.
Referral partners must not:
- Submit knowingly false or misleading customer information.
- Represent themselves as authorized to make commitments on behalf of Proactive Energy Solutions unless expressly authorized.
- Promise specific pricing, financing approval, tax outcomes, utility savings, installation dates, equipment availability, or project results unless confirmed in current approved documents.
- Submit personal information obtained without appropriate permission.
- Use the Partner Portal for unlawful, deceptive, fraudulent, or abusive purposes.
4. Sales Representative Responsibilities
Sales representatives and other authorized users must follow current company policies, approved pricing, approved product information, applicable licensing requirements, financing requirements, consumer-protection standards, and project-specific documentation.
Representatives should not make guarantees or commitments beyond current approved agreements, manufacturer specifications, lender requirements, utility rules, or company policies.
5. Estimates, Proposals, and Project Information
Preliminary designs, energy estimates, savings illustrations, project timelines, system sizes, equipment selections, production estimates, and pricing may change after site survey, engineering, utility review, permitting, financing approval, or other project-specific review.
A preliminary proposal does not replace the final written customer agreement, engineering documents, financing agreement, manufacturer warranty, or utility approval.
6. Solar and Battery Performance
Solar production and battery performance depend on many factors, including weather, shading, roof orientation, system design, equipment, household energy consumption, battery settings, utility rates, and other conditions.
Unless expressly stated in a written agreement, information provided through the website or Partner Portal should not be interpreted as a guarantee of particular energy production, savings, battery runtime, or utility-bill reduction.
7. Utility, Permitting, and Third-Party Delays
Project timelines may depend on utilities, cities, counties, fire authorities, HOAs, financing providers, inspectors, manufacturers, contractors, and other third parties outside our direct control.
Estimated timelines are not guarantees unless expressly stated in a binding written agreement.
8. Financing
Financing products are offered by third-party lenders and are subject to lender approval, credit requirements, program availability, interest rates, fees, eligibility criteria, and applicable terms.
Proactive Energy Solutions does not guarantee financing approval. Customers should review all financing documents before agreeing to a loan or other financing arrangement.
9. Taxes and Incentives
Information regarding federal, state, local, utility, or other tax credits, rebates, incentives, or benefits is provided for general informational purposes only.
Proactive Energy Solutions does not provide legal, tax, or accounting advice and does not guarantee that any customer will qualify for or receive a specific tax benefit, credit, rebate, or incentive.
Customers should consult an appropriate tax or legal professional regarding their individual circumstances.
